We’d rather you read this before we ever talk than find it in the fine print. Here is how we operate.
We are investors, not your agent
Batista Property Investments LLC is a real estate investment company. We are not acting as your real estate agent or broker and we do not represent your interests in the transaction. You are encouraged — and always free — to have a licensed real estate agent, an appraiser, or an attorney review any offer or agreement before you sign it.
Our offer is below market value
We buy houses to renovate and resell, or to hold as rentals. The price we offer is typically below the property’s full market value. In exchange, you pay no commissions or fees, make no repairs, and choose the closing date. We show you how we arrived at the number so you can compare it with other options.
We may assign our contract to a partner buyer
Sometimes we purchase directly. Sometimes we bring in a partner buyer from our network and assign our rights under the purchase agreement to that buyer for a fee. We may market our contractual interest to partner buyers before closing. If we do, your purchase price, closing date and protections do not change. Every purchase agreement we sign includes a written disclosure of this in a separate, signed page.
Your right to cancel
Where state law provides a cancellation period for wholesale or assignable purchase agreements, the agreement will state it, and we honor it. Regardless of state, our purchase agreement states in writing what happens to your earnest money deposit, which is held by a licensed title company or closing attorney — never by us.
Foreclosure and mortgage matters
We are not a mortgage relief, loan modification, or foreclosure rescue service, and we are not affiliated with any lender or government agency. We never charge fees. We never advise anyone to stop making mortgage payments. If you are facing foreclosure, free help is available from HUD-approved housing counselors at 1-800-569-4287 or hud.gov/findacounselor.
“Cash” and closing
“Cash offer” means an offer with no financing contingency. It does not mean closing is guaranteed; closing depends on clear title and the terms of the written agreement. Proof of funds is available on request.
Equal housing
We do business in accordance with the federal Fair Housing Act and state fair-housing laws.
